AGREEMENT 1- All prices on terms are negotiated depending upon the workload, time frame and conditions the horses and equipment are used. 2- All horses can be shod for an additional $60.00 per head. 3- The lessor can deliver and pick up horses and equipment for an additional fee per head. 4- The Lessor reserves the right to inspect the horses, equipment, feed, facilities at anytime. 5- Upon signs of abuse, neglect, inhumane treatment or conditions, the Lessor reserves the right to terminate the lease agreement immediately and take full position of all horses and equipment. 6- The Lessee agrees to be responsible for the care and treatment of the horses and equipment and agrees to pay all necessary veterinary costs or other associated costs for the care and treatment of said horses during the term of this lease agreement including maintaining said horses and equipment in a good manner providing necessary feed, shoeing, and other care necessary to keep said horses in good condition and agrees not to misuse said horses during the term of this agreement and agrees to keep said horses in safe and clean facility. 7- REPLACEMENT OF LOST OR INJURED HORSES AND OR EOUIPMENT . The Lessee agrees that they will be solely responsible for the care and treatment of the horses and the tack and equipment that is leased pursuant to this agreement and in the event that there is any damage or loss of the tack equipment, then the Lessee agrees to pay for all repair and or replacement costs based upon the fair market value thereof and further agrees to nay for the fair market valuefor the lose, death and or injury or down time of any horse due to abuse, neglect, or mishandling. 8- All judgment calls on the condition of the horsed; equipment and facilities will be left to the sole discretion of the lessor. 9- DELIVERY AND ACCEPTANCE . The Lessee agrees that he/she has accepted the horses and tack equipment listed hereinabove and that said horses and equipment are in fit condition for the use as provided for this agreement. 10- ATTORNEY'S FEES . In the event that suit or action is instituted in connection with any controversy arising out of this agreement, then Clark Horses shall be entitled to recover in addition to any such amounts recovered under this agreement an additional amount for reasonable attorney's fees, with or without suit, and Lessee agrees to pay said attorney's fees and Court costs in addition to any amount due in owing under this agreement. RELEASE In consideration of being permitted to rent and use the horses (herein referred to as “activity”) and/or equipment hereinabove described which is owned by Clark Horses the undersigned as Releasor for him or herself, their spouse, legal representatives, heirs and assigns, hereby releases, waives and discharges Clark Horses, their officers and members, owners, employees, heirs, all of them from any and every claim, demand, action or right of action, of whatever kind or nature, either in law or in equity arising from or by reason of any bodily injury, or personal injuries known or unknown, death or property damage resulting or to result from any accident which may occur as a result of the above described activity, and/or activities in connection therewith whether by negligence or not. a Releasor agrees to indemnify Clark Horses and each of them from any loss, liability, damage or cost they may incur due to the above described activity, whether caused by the negligence of Clark Horses or otherwise. b Releasor hereby assumes full responsibility for the risk of bodily injury, death or property damage due to the negligence of Clark Horses or otherwise in or upon Clark Horses property and! or using Clark Horses horses or for any purpose while participating in said activity. c Releasor expressly agrees that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of Wyoming, and that if any portion therof is held invalid, it is agreed that the balance shall come and not withstanding, continue in full legal force and effect.
d Releasor further states that he/she has carefully read the foregoing release and knows the contents thereof and signs this release at his/her own free act. e Releasor further states that he/she knows the inherent risk associated with the activity and uses associated with horses, and is willing to assume such risk. f In the event the participant in the above described activity is a minor the undersigned parent/guardian of said minor hereby grants permission for his/her child to participate in the activity described above knowing full well the potential dangers involved and agrees to release any and all claims on behalf of said minor as a result of said activity.
